Terms and Conditions

1. General Terms

These Terms and Conditions (the "Terms") govern the relationship between Individual Entrepreneur (FOP) Pavlo Anatoliyovych Yarko, trading as Vytivka (hereinafter "Organizer", "we", "us"), and the person using the vytivka.travel website and/or participating in our journeys (hereinafter "Participant", "you").

By registering for a journey, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. Description of Services & Flights

Vytivka organizes boutique group journeys, which include: itinerary planning, accommodation booking, transfers, an experienced guide/leader, specified meals, and activity coordination.

Important Notice Regarding Flights: Flights to and from the destination are NOT included in the journey price and do not form part of a travel package. You are responsible for booking and paying for your own flights. Your contract for the flight is strictly between you and the airline.

3. Booking and Payment

The booking process involves filling out a form, meeting the organizer (online/offline), and paying a deposit. Your place is strictly secured only upon receipt of the first deposit.

Payments are typically split into two stages (initial deposit to secure the spot, and a second payment once the trip is confirmed to run) or an individual plan. All prices are in Euros (EUR).

4. Cancellations and Refunds

4.1 Cancellation by Participant:

Up to 60 days before the start: 100% refund (any currency exchange differences are split 50/50).
59 to 32 days before the start: 100% of your deposit is converted into credit, valid for any Vytivka journey within 12 months.
31 days or less: No refund is possible (as funds have already been committed to accommodation/transport). We will endeavor to recover and credit as much of your deposit as possible for future use, but this is not guaranteed.

4.2 Changes to the Itinerary:

Minor Changes: We reserve the right to alter the daily schedule or specific locations due to weather or safety. Such changes do not entitle you to a refund.

Significant Changes: If, prior to departure, we are forced to significantly alter the dates of the journey or drastically downgrade the standard of accommodation, you will be notified and have the right to either accept the change or cancel with a full (100%) refund.

5. Participant Requirements

Participants must be at least 18 years old, possess a passport valid for at least 6 months beyond the return date, and obtain any necessary visas. You must disclose any pre-existing medical conditions, allergies, or physical limitations prior to booking.

6. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence.

However, we shall not be held liable for:

Injuries sustained as a result of your failure to follow the guide's instructions, safety rules, or your own negligence;
Flight delays, cancellations, or lost luggage caused by airlines;
Circumstances beyond our control (Force Majeure), including natural disasters, pandemics, or political instability.

7. Mandatory Travel Insurance

Comprehensive travel insurance is mandatory for participation. Your policy must cover overseas medical expenses, active sports (e.g., altitude hiking, surfing), medical evacuation, and repatriation. The Organizer accepts no liability for any costs incurred due to your failure to obtain adequate insurance coverage.

8. Code of Conduct & Media

Participants are expected to respect fellow travelers, the schedule, and the local environment. We reserve the right to remove any Participant from the journey, without refund, for gross misconduct or endangering the group.

By joining, you consent to our use of photos/videos featuring you for promotional purposes. If you wish to opt-out, please inform us before the journey begins.

9. Governing Law & Consumer Rights

These Terms shall be governed by and construed in accordance with the laws of Ukraine. However, if you are a consumer residing in the United Kingdom or the European Union, this choice of law will not deprive you of the mandatory consumer protection rights granted to you by the laws of your country of residence.
